Jana Paw\u0142a II 29, 00-867 Warsaw).<\/p>\n<p class=\"p1\">In the case of opting for the SwissSafety service (which allows storage of the collected material in Poland and Switzerland), the controller of personal data will also be\u00a0Famicord Suisse SA, based in Switzerland, c\/o Studio Fiduciario Pagani SA, Corso Pestalozzi 3, 6900 Lugano.<\/p>\n<p class=\"p1\">In the case of joining a group life insurance contract offered to PBKM clients, the data controller will also be\u00a0SIGNAL IDUNA Polska TU S.A. with registered office at ul.<br \/>\nSiedmiogrodzka 9, 01-204 Warsaw\u00a0If additional studies are selected, data controllers will also be:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">Novogenia GmbH, headquartered in Austria, Saalachstrasse 92, 5020 Salzburg\u00a0(for screening);<\/li>\n<li class=\"li1\">Genomed S.A, based in Warsaw at ul.<br \/>\nPonczowa 12\u00a0(for molecular genetic testing).<\/li>\n<\/ul>\n<\/div>\n\t\t\n        \t<\/div>\n<\/section>\n\n\n<section class=\"section-with-heading-and-text section-margin section-margin--small\">\n\t<div class=\"container\">\n\n\t\t\t\t\t\n\t\t\t\n    <h4   class=\"  text-blue break-words \">\n\n            Personal Data Inspector\n\n    <\/h4>\n\n\t\t\n\t\t\t\t\t\t\t\t<div class=\"mt-24 xl:mt-40 xl:ml-100 space-y-24  xl:max-w-[78rem]\"><p class=\"p1\">PBKM has appointed a Data Protection Inspector (Agnieszka Wierci\u0144ska-Kru\u017cewska). break-words \">\n\n            Information collection policy\n\n    <\/h4>\n\n\t\t\n\t\t\t\t\t\t\t\t<div class=\"mt-24 xl:mt-40 xl:ml-100 space-y-24  xl:max-w-[78rem]\"><p class=\"p1\">The www.pbkm.pl website processes personal data in accordance with applicable regulations, in particular in accordance with Regulation (EU) 2016\/679 of the European Parliament and of the Council of April 27, 2016.<br \/>\non the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95\/46\/EC (\u201cRODO\u201c).<br \/>\nAny inquiries submitted to us will be processed with confidentiality and commercial confidentiality.<br \/>\nPersonal data and email addresses will not be used for any purpose other than to respond to an inquiry submitted or for the conclusion and performance of a contract with PBKM.<br \/>\nIn particular, personal data will not be used to provide commercial information in the future about services other than directly related to the submitted inquiry, nor will they be transferred to third parties, unless the user agrees to receive commercial information and\/or other forms of contact.<\/p>\n<\/div>\n\t\t\n        \t<\/div>\n<\/section>\n\n\n<section class=\"section-with-heading-and-text section-margin section-margin--small\">\n\t<div class=\"container\">\n\n\t\t\t\t\t\n\t\t\t\n    <h4   class=\"  text-blue break-words \">\n\n            Purpose and legal basis of data processing\n\n    <\/h4>\n\n\t\t\n\t\t\t\t\t\t\t\t<div class=\"mt-24 xl:mt-40 xl:ml-100 space-y-24  xl:max-w-[78rem]\"><p class=\"p1\">The processing of personal data will take place:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">For the fulfillment of contractual obligations (Article 6(1)(b) RODO)<\/li>\n<\/ul>\n<p class=\"p1\">The data is processed for the purpose of performing PBKM\u2019s activities in the execution of contracts concluded with clients or for pre-contractual activities that are performed at the request of the client.<br \/>\nData processing is necessary for qualification, preparation and storage of collected biological material.<br \/>\nThe data is also processed for the establishment of the user\u2019s account in the e-store and the handling of the contract concluded with PBKM through the e-store.<\/p>\n<ul class=\"ul1\">\n<li class=\"li2\">For the fulfilment of legal obligations related to the settlement of the contract and the fulfilment of tax and accounting obligations (Article 6(1)(c) of the GDPR)<\/li>\n<\/ul>\n<p class=\"p1\">The data is processed in order for PBKM to fulfil legal obligations related to the settlement of the contract, resulting in particular from tax laws and the Accounting Act.<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">Based on explicit consent (Article 6(1)(a) and Article 9(2)(a) of the RODO)<\/li>\n<\/ul>\n<p class=\"p1\">Entering into a contract for the qualification, preparation and storage of collected biological material involves the processing of health data, which is a special category of data.<br \/>\nData on health and processed for the purpose of depositing biological material for public purposes in a public bank are processed on the basis of consent.<br \/>\nBased on consent, we also process personal data for email or telephone contact for the purpose of making a business offer.<br \/>\nConsent may be withdrawn at any time.<br \/>\nThe withdrawal of consent does not affect the lawfulness of data processing until the consent is withdrawn.<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">for the fulfillment of legal obligations (Article 6(1)(c) RODO) or the performance of tasks carried out in the public interest (Article 6(1)(e) RODO)<\/li>\n<\/ul>\n<p class=\"p1\">As a cord blood bank and a medical entity, we are subject to a number of legal obligations, i.e.<br \/>\nrequirements arising, for example, from the Law on Patients\u2019 Rights and the Patients\u2019 Ombudsman and the Law on the Collection, Storage and Transplantation of Cells, Tissues and Organs.<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">for the purpose of conducting marketing activities consisting in:<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul class=\"ul1\">\n<li class=\"li2\">sending commercial information about offers or content regarding the Controller\u2019s products and services in connection with the customer\u2019s consent to receive commercial information through a specific communication channel (Article 6(1)(a) of the GDPR)\n<p>In order to send commercial information about offers or content related to PBKM\u2019s products and services, only the personal data of individuals who have consented to receive such commercial information through a selected communication channel are processed. Such consent may be withdrawn at any time.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul class=\"ul1\">\n<li class=\"li2\">directing advertising to customers who have visited the Controller\u2019s website on other websites and social networks (remarketing) (Article 6(1)(f) of the GDPR in conjunction with the customer\u2019s consent to the use of tracking technologies that rely on information about their use of the website)<br \/>\nIn order to conduct remarketing activities, PBKM processes the personal data only of those users who have consented to the use of tracking technologies which use information about their activity on the website. Users may withdraw such consent at any time. The process of displaying or re-displaying personalized ads involves trusted partners of the Controller, a detailed list of which is provided under <b>\u201cOn-site analytical tools\u201d<\/b> section.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"p6\">Once consent is granted, the User\u2019s personal data collected as part of other processing activities performed by the Controller may be used for profiling. This means that the Controller analyses selected aspects concerning the user in order to assess their behaviour or predict future needs. This allows to better match content to the individual preferences and interests of the user, including presenting properly tailored advertisements and sending commercial information in accordance with their expectations.<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">for other purposes arising from the legitimate interests pursued by PBKM (Article 6(1)(f) RODO)<\/li>\n<\/ul>\n<p class=\"p1\">If necessary, we process data to protect our legitimate interests.<br \/>\nExamples of this include:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">Handling user inquiries and contacting potential customers;<\/li>\n<li class=\"li1\">customer satisfaction survey,<\/li>\n<li class=\"li1\">Investigation of claims and defense against claims,<\/li>\n<li class=\"li1\">Ensuring the safety of biological material,<\/li>\n<li class=\"li1\">Ensuring IT security, including the functionality of the website.<\/li>\n<\/ul>\n<\/div>\n\t\t\n        \t<\/div>\n<\/section>\n\n\n<section class=\"section-with-heading-and-text section-margin section-margin--small\">\n\t<div class=\"container\">\n\n\t\t\t\t\t\n\t\t\t\n    <h4   class=\"  text-blue break-words \">\n\n            Recipients of personal data\n\n    <\/h4>\n\n\t\t\n\t\t\t\t\t\t\t\t<div class=\"mt-24 xl:mt-40 xl:ml-100 space-y-24  xl:max-w-[78rem]\"><p class=\"p1\">Personal data may be shared with other recipients in order to perform a contract, to comply with PBKM\u2019s legal obligation, based on consent, or for purposes arising from the legitimate interests of the administrator referred to herein.<br \/>\nRecipients may be, in particular: authorized employees of a business information bureau, credit and payment institutions, a law firm providing services to PBKM, a courier company delivering a contract or download kit.<br \/>\nIn addition, data may be transferred to entities that process personal data on behalf of PBKM and their authorized employees, with such entities processing data on the basis of a contract with PBKM and only in accordance with instructions and subject to confidentiality and adequate protection of personal data security.<br \/>\nIf the service is selected:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">SwissSafety, data will be shared with Famicord Suisse, for the purpose of executing the concluded contract.<br \/>\nThe information clause regarding the processing of data by Famicord Suisse can be found in the contract concluded with the company;<\/li>\n<li class=\"li1\">accession to group life insurance, data will be made available to SIGNAL IDUNA Polska TU S.A. Information clause on data processing by SIGNAL IDUNA Polska TU S.A. is included in the Declaration of accession;<\/li>\n<li class=\"li1\">to perform the screening test, the data will be shared with Novogenia GmbH for the purpose of performing the test.<br \/>\nThe processing information clause can be found on the company\u2019s website;<\/li>\n<li class=\"li1\">to perform a molecular genetic test, the data will be shared with Genomed S.A. for the purpose of performing the test.<br \/>\nThe processing information clause can be found on the company\u2019s website.<\/li>\n<\/ul>\n<\/div>\n\t\t\n        \t<\/div>\n<\/section>\n\n\n<section class=\"section-with-heading-and-text section-margin section-margin--small\">\n\t<div class=\"container\">\n\n\t\t\t\t\t\n\t\t\t\n    <h4   class=\"  text-blue break-words \">\n\n            Duration of storage of personal data\n\n    <\/h4>\n\n\t\t\n\t\t\t\t\t\t\t\t<div class=\"mt-24 xl:mt-40 xl:ml-100 space-y-24  xl:max-w-[78rem]\"><p class=\"p1\">Personal data will be processed for the period necessary to achieve the purposes of processing, in particular:<\/p>\n<ul class=\"ul1\">\n<li class=\"li1\">with regard to the execution of the contract concluded with PBKM \u2013 until the completion of its execution, and after that time for the period required by law or for the realization of possible claims;<\/li>\n<li class=\"li1\">in terms of fulfilling legal obligations incumbent on PBKM in connection with the conduct of its business and performance of concluded contracts \u2013 until PBKM fulfills these obligations;<\/li>\n<li class=\"li1\">with regard to direct marketing carried out on the basis of consent or any PBKM\u2019s activities carried out by PBKM based on your consent \u2013 until you withdraw your consent to such processing;<\/li>\n<li class=\"li1\">until the PBKM\u2019s legitimate interests forming the basis for such processing are fulfilled or until you object to such processing, unless there are legitimate grounds for further processing.<\/li>\n<\/ul>\n<\/div>\n\t\t\n        \t<\/div>\n<\/section>\n\n\n<section class=\"li1\">request the transfer of personal data processed for the purpose of entering into and performing a contract or processed on the basis of consent.<br \/>\nA transfer consists of receiving personal data from the PBKM, in a structured, commonly used machine-readable format, and sending such data to another data controller.<br \/>\nThe right to data portability does not apply to data that constitute company secrets,<\/li>\n<li class=\"li1\">lodge a complaint with the President of the Office for Personal Data Protection, in case the processing of personal data is deemed to violate the Cookies constitute digital data, including, but not limited to small text files that are\u00a0stored on the user\u2019s terminal device (e.g.\u00a0laptop, tablet, smartphone) when they visit the <a href=\"https:\/\/www.pbkm.pl\/\"><span class=\"s1\">www.pbkm.pl<\/span><\/a> website. They can be used by the Controller \u2013 in such a case they are installed directly by the <a href=\"https:\/\/www.pbkm.pl\/\"><span class=\"s1\">www.pbkm.pl<\/span><\/a> website, as well as by the Controller\u2019s partners (e.g.\u00a0Google) \u2013 in this case, the cookies originate from a different website than the one visited by the user.<\/p>\n<p class=\"p2\">Cookies store information that is created in cooperation with the user\u2019s terminal device. The cookies used on the <a href=\"https:\/\/www.pbkm.pl\/\"><span class=\"s1\">www.pbkm.pl<\/span><\/a> website are primarily used to ensure the proper functioning of the site, including maintaining a login session. If the user grants separate consents to the installation of other cookies, they will also be used for the purpose of adjusting the website, analytical and marketing settings.
